Terms & Conditions

These Terms & Conditions (“T&Cs”) will apply to any use by you (the “User”) of the Loyal Source Government Services (LSGS) System provided to the Department of Veteran’s Affairs (the “System”). By using this system, you agree to be bound by these T&Cs, which constitute a valid and binding agreement between you and LSGS. Please read these T&Cs carefully so that you know what your rights and obligations are when using the System.

• General Terms
  • These T&Cs applies to the use of, and access to, the LSGS system by the User. If the User does not agree with these T&Cs, the User may not use the System.
  • The T&Cs at any time can be amended at any time as need arises. By continuing to use the System after the T&Cs have been amended, the User accepts the amended T&Cs. If the User does not agree with the T&Cs at any time, the User’s exclusive remedy is to stop using the System.
  • If any provision in these T&Cs are held to be invalid or unenforceable, the other provisions of these T&Cs shall remain in full force and effect. In such a case, LSGS will replace the void or unenforceable provisions with new ones. In doing so, the purpose and meaning of the void or unenforceable provisions will be taken into account as far as possible.
• License and Use
  • LSGS hereby grants the User a limited, revocable, non-exclusive, non-transferable right to access and use the System pursuant to these T&Cs (the “License”).
• Intellectual Property Rights
  • User acknowledges and agrees that LSGS and its licensors (where applicable, including Infinite Computer Solutions, Inc.) retain all rights, title, and interest, including, without limitation, rights and know-how recognized under patent law, copyright law, data rights and data protection laws, trade secrets law, or similar proprietary rights (“Intellectual Property Rights”) to the technology, programming code, content management system and all other assets relating to the System, as well as to any modifications, adaptations or translations thereof.
  • User is not permitted to sell, rent out, transfer, modify, create derivative works or copy the System, alter or remove any copyright, patent, trademark, or other protective notices included with the System; reverse engineer, decompile, or disassemble the System or otherwise attempt to derive any related source code; or make it available to third parties in any way or for any purpose not expressly permitted in these T&Cs.
  • LSGS will be permitted to implement technical safeguards (e.g. data logging) for the purpose of protecting the System. User is not allowed to remove or circumvent such technical provisions.
• System Content
  • The System contains the following data: Medical disability results of veterans, Contract Exam Management requests, and the transmission of Disability Benefits Questionnaires (DBQ). The information is collected to aid processing of exam requests from the VA VBMS systems via DAS and to manage the delivery of medical disability results to the VA.
  • The User acknowledges and agrees that LSGS does gather data for export to electronic and personal health records.
• Privacy
  • All data entered into the System will be stored in a secure cloud computing environment in accordance with FedRAMP standards.
  • The User is solely responsible for accurately entering data into the System.
  • By using this System, the User acknowledges that information collected is only to be used for the purpose of assisting with Veteran’s Benefit Administration and processing.
• Disclaimer
  • The System is provided on an “as is” basis without warranty of any kind. Moreover, LSGS does not warrant that the Service will be error-free, complete, or up-to-date at all times.
  • LSGS does not guarantee that the System or any part thereof will be accessible at all times and without any interruptions or failures. Failures in the System can occur as a result of software defects or as a result of viruses and/or interferences with other software systems installed in the device.
• Limitation of Liability
  • To the maximum extent permitted by any applicable law, neither LSGS or its licensors shall be liable for any direct, indirect, incidental, or consequential damage, or any other damage, loss (including loss of profit and loss of data), costs, expenses and payments, either in tort, contractual, or in any other form or theory of liability, arising from, or in connection with the use of, or the inability to use, the System, or from any failure, error, or breakdown in the function or availability of the System, or from any fault or error made by the involved persons’ staff or anyone acting on their behalf. In any event, the User’s sole remedy shall be to discontinue the use of the System and contact the LSGS support desk (+1 833-832-7077).
• Indemnification
  • The User indemnifies and holds LSGS harmless against any and all claims by third parties in connection with or resulting from the User’s use of the System, a violation by the User of these T&Cs, and/or any unlawful activities. This includes, without limitation, any activities that constitute an infringement of Intellectual Property Rights or any other rights of third parties.
• Term and Termination
  • LSGS may terminate these T&Cs, including your license to use the System at any moment by giving you notice of such termination. Upon termination by LSGS, you must discontinue all use of the System and contact the VA support desk.
  • You may terminate these T&Cs at any time by discontinuing the use of the System and contacting the LSGS help desk (+1 833-832-7077).
• Modification to the System
  • LSGS is entitled to change and/or update the System and replace the design and layout of any of the functionalities of the System without any prior notification and without being obliged to pay any compensation whatsoever to the Users.
  • LSGS is entitled to put the System out of service and/or to reduce the use of it without any prior notification and without being obliged to pay any compensation whatsoever to the User, if in the opinion of LSGS such action is necessary; for example, in connection with required maintenance of the System, or due to force majeure (such as site or building blockades, strikes, riots, civil disruption, war, terrorist acts, inclement weather, epidemic, specific work interruptions, delay in transportation, earthquake, fire, storm, flood, or water damage, delay in or cancellation of the delivery parts, goods or services ordered from third parties, or governmental, legal or regulatory restrictions).
• RULES OF BEHAVIOR FOR USERS
  • You must conduct only authorized use on the System. System is to be used solely for the purpose of entering information to help support Veteran’s Benefits Administration and processing.
  • Your level of access to systems and networks owned by third-party contractors is limited to ensure your access is no more than necessary to perform your legitimate tasks or assigned duties. If you believe you are being granted access that you should not have, you must immediately notify the LSGS Support desk (+1 833-832-7077).
  • You must maintain the confidentiality of your authentication credentials such as your password. Do not reveal your authentication credentials to anyone.
  • You must follow proper logon/logoff procedures. You must manually logon to your session; do not store your password locally on your system or utilize any automated logon capabilities. You must promptly logoff when session access is no longer needed. If a logoff function is unavailable, you must close your browser. Never leave your computer unattended while logged into the System.
  • Your access to System subject to, all federal laws, regulations, standards and VA Policies, including, but not limited to, the Privacy Act of 1974, 5 U.S.C. 552a, HIPAA Privacy Rule, 45 Code of Federal Regulations (C.F.R) Part 164, Standards for Privacy of Individual Identifiable Health Information 58VA21/22/28 – Compensation, Pension, Education and Vocation Rehabilitations and Employment Records, Confidentiality of Certain Medical Records, 38 U.S.C, VA Directive 6500 (which is available at: https://www.va.gov/vapubs/search_action.cfm?dType=2 )
  • You must not process U.S. classified national security information on the System.
